Terms of Use, Carobi

These terms are a binding agreement between you and James Horsman (sole proprietor), trading as Carobi, FDRK0910, Compass Building, Al Shohada Road, Al Hamra Industrial Zone-FZ, Ras Al Khaimah, United Arab Emirates ("Carobi", "we", "us"). By using Carobi you agree to them.
1. What the app is
Carobi is a personal tool for recording a pet's medication, food, water and toileting, sending on-device reminders, and optionally sharing those records with people you invite.
2. Not veterinary advice; not a medical device
Carobi is for personal record-keeping only. It does not provide veterinary or medical advice, diagnosis or treatment, and must not be relied on as a substitute for professional guidance, always follow your vet's instructions. Carobi is not a medical device, and its reminders are not a safety-critical or emergency alerting system. Reminders are scheduled on your device and may not always deliver (e.g. if notifications are off, the device is unavailable, or due to the operating system). Do not rely on them as your only safeguard, or in any situation where a missed or delayed reminder could cause harm. You are responsible for your pet's care and for the accuracy of what you record.
3. Your account
You must be 16 or over. Keep your login secure; you're responsible for activity under your account. Don't misuse the service or try to access data you're not authorised to see.
4. Sharing
If you invite someone to a pet, they can view and add to that pet's records, and what they add stays in the shared record. Each member is responsible for the accuracy of their own entries; the pet owner can remove a member's access at any time. We are not responsible for content other members add. Only invite people you trust.
5. Subscriptions
Carobi is offered with a 7-day free trial, after which continued use requires a paid subscription:
- Carobi, $14.99 / year (use with up to 3 pets) or Carobi Professional, $99.99 / year (unlimited pets; intended for veterinary practices, kennels, rescues and similar), in each case at the local-currency equivalent set by the App Store. The first 7 days are free; we do not take payment to start the trial.
- When you choose to subscribe, payment is charged to your Apple ID at confirmation of purchase. The subscription auto-renews at the price above unless you turn off auto-renew at least 24 hours before the end of the current period; your account is charged for renewal within 24 hours before the period ends.
- Manage or cancel anytime in your Apple account settings; you can restore an active subscription with "Restore Purchases" in the app.
- Apple is the merchant of record. We cannot issue App Store refunds; refund requests are handled by Apple via "Report a Problem" (reportaproblem.apple.com).
- Digital content/subscriptions are supplied immediately at your request once you subscribe; any cancellation is exercised through Apple as above.
6. Availability
We aim to keep the service running but don't guarantee uninterrupted availability, and we reserve the right to amend, change or discontinue features.
7. Our responsibility to you
Nothing in these terms limits or excludes our liability where it cannot lawfully be limited or excluded - including liability for death or personal injury caused by our negligence, for fraud or gross misconduct, or for any rights you have under the UAE Consumer Protection Law (Federal Law No. 15 of 2020) and its implementing regulations, which are not affected by anything here.
Subject to that:
- We are not liable for losses that are not a reasonably foreseeable result of our breach, or that arise from your misuse of the app, from your device or operating system (including notification delays or failures outside our control), or from inaccurate information you or other members enter.
- So far as the law allows, our total liability to you for any claim is limited to the greater of (a) the amount you paid us in the 12 months before the event, or (b) USD 100.
8. Changes to these terms
We may update these terms. For significant changes we'll give reasonable notice (in-app or by email) before they take effect. If you don't agree, you can stop using the app and cancel any subscription via Apple before the change takes effect.
9. Termination
You can stop using the app and delete your account at any time from within the app (Settings → Delete account), which permanently deletes your account and associated server-side records (subject to the brief backup window and shared-record retention described in our Privacy Policy). We may suspend accounts that breach these terms.
10. Apple
This agreement is between you and us, not Apple. Apple has no obligation to provide support or maintenance for Carobi and is not responsible for the app, any claims relating to it, or any third-party intellectual- property claims. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them.
11. Governing law & disputes
These terms, and any dispute, claim or grievance arising out of or in connection with them, the app, or your use of Carobi (including non-contractual disputes), are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai. You agree that the Dubai International Financial Centre (DIFC) Courts shall have exclusive jurisdiction to hear and settle any such dispute, and you irrevocably submit to that jurisdiction. Nothing in this clause removes any mandatory consumer-law protection you have under the law of your country of residence.
